The platform HoopVerse and its subdomains are operated by Pillar Interactive SAS, a company registered under the laws of France.

2. Definitions

• Game: The online basketball management simulation developed by HoopVerse.
• Platform: The HoopVerse website and web application.
• User: Any person who accesses or interacts with the Platform.
• Subscription: The recurring payment plan that provides access to the HoopVerse game and all its features.
• Free Trial: A 7-day period during which new Users can access the full game at no cost.
• Collectibles: Digital assets representing basketball players or franchises in HoopVerse.

3. Purpose and Scope

These Terms of Service ("TOS") govern the use of HoopVerse, including the Game and other services.

Users acknowledge that these TOS regulate only the relationship between them and HoopVerse, excluding any third-party service provider.

4. Subscription Model

4.1 Free Trial

New Users are entitled to a 7-day free trial upon registration. During this period, Users will have full access to the Game without any restrictions.

No payment information is required to start the free trial. Users will receive notifications before the end of their trial period.

4.2 Subscription Requirement

After the free trial period ends, Users must subscribe to continue accessing and playing the Game. The subscription is required to manage a team and participate in the HoopVerse basketball universe. HoopVerse offers various subscription plans with different billing periods and prices, which are displayed on the subscription page.

4.3 Billing and Renewal

Subscriptions automatically renew at the end of each billing period unless canceled by the User. Payment is processed at the beginning of each billing cycle.

4.4 Cancellation Policy

Users may cancel their subscription at any time. Upon cancellation, the User will maintain access to the Game until the end of the current billing period. After this period expires, access to the Game will be restricted. No refunds will be provided for partial subscription periods.

5. Acceptance and Amendments

5.1 Acceptance

Users must read and accept these TOS before accessing the Platform. By creating an account or subscribing to the service, Users acknowledge full acceptance of these TOS.

5.2 Amendments

HoopVerse may modify these TOS periodically. Users will be notified of significant changes at least 15 days in advance. Continued use of the Platform constitutes acceptance of the revised terms.

6. Access to Services

6.1 Eligibility

Users must have full legal capacity in their jurisdiction. Minors may use the Platform under the supervision of a legal guardian.

6.2 Account Registration

Users must create an account using their email, social login options such as Facebook, or phone number. The security of the account is the sole responsibility of the User.

6.3 Account Suspension and Termination

HoopVerse reserves the right to suspend or terminate accounts in case of:

• Fraudulent activities.
• Violations of these TOS.
• Illegal activities related to the Game.
• Non-payment of subscription fees.

7. Characteristics of Services

7.1 Game Features

HoopVerse provides a basketball management simulation with features including team management, player recruitment, league competitions, and social interaction with other Users.

7.2 In-Game Economy

The Game features a virtual currency and economy system for in-game transactions. Virtual currency has no real-world value and cannot be exchanged for real money.

7.3 Game Participation

Users may manage basketball franchises, sign players, and engage in competitions. HoopVerse reserves the right to adjust gameplay mechanics, player attributes, competition structures, and economic systems to maintain competitive balance and enhance user experience.

8. User Conduct

Users agree to:

• Comply with applicable laws and regulations.
• Use the Platform in good faith.
• Refrain from disruptive activities, hacking, or fraudulent behavior.
• Avoid offensive, defamatory, or illegal content in interactions.
• Not share account credentials or transfer subscriptions to other individuals.

Violation of these rules may result in account suspension or termination.

9. Intellectual Property

9.1 Platform Content

All elements of HoopVerse (logos, designs, text, game mechanics) are owned by HoopVerse. Users may not copy, distribute, or exploit them without authorization.

9.2 User-Generated Content

By creating team names, logos, or other content, Users grant HoopVerse a royalty-free, transferable license to use and display this content for promotional and gameplay purposes.

10. Data Privacy

HoopVerse collects and processes personal data in accordance with our Privacy Policy. By accepting these TOS, Users acknowledge they have read and understood the Privacy Policy.

Payment information is processed by secure third-party payment processors and is not stored on HoopVerse servers.

11. Liability and Indemnification

11.1 Limitations of Liability

HoopVerse provides the Platform "as is" and makes no guarantees regarding uninterrupted service or security. HoopVerse is not liable for any losses resulting from service interruptions, data loss, or third-party payment processing issues.

11.2 Indemnification

Users agree to indemnify HoopVerse against any claims, losses, or damages arising from their misuse of the Platform.

12. Duration, Suspension, and Termination

12.1 Duration

These TOS remain effective as long as the User accesses the Platform.

12.2 Suspension and Termination

HoopVerse may suspend or terminate User accounts due to breaches of these TOS, non-payment, or as required by regulatory changes.

12.3 Effect of Termination

Upon termination of an account, the User will lose access to the Game and all its features, including any virtual assets or progress. No refunds will be issued for unused subscription periods.

13. Dispute Resolution

Governing Law: These TOS are governed by French law.

Arbitration: In case of disputes, Users must first contact HoopVerse at mathis@hoopverse.gg. If unresolved, disputes may be resolved through mediation or arbitration in France.
